Playco Subscription Terms

These Terms:

These Subscription Terms govern your purchase and use of Playco’s subscription products (“Subscription”), which include Heads Up! Gold, #Ask Away Gold, Sway Stories Supporters, and other subscription-based products that we may make available from time to time (each a “Subscription Product”). Your Subscription is governed by these Subscription Terms. Please be sure to read the full Terms below, but a few important points are highlighted here:

  • SUBSCRIPTIONS AUTOMATICALLY RENEW UNTIL CANCELED. Monthly subscriptions renew on a monthly basis, and weekly subscriptions renew on a weekly basis. The applicable renewal period for each Subscription Product is listed under Subscription Options below. To cancel a Subscription, please follow the directions for the applicable Subscription Product under Cancellations below. Monthly subscriptions renew on a monthly basis, and weekly subscriptions renew on a weekly basis.
  • If you cancel a Subscription, we will not automatically renew your Subscription for the following Subscription Period (defined below under “Payments and Renewals”). However, we do not provide refunds for Subscription Periods that have been paid, except where required by law.
  • We may transfer your personal data, including payment information, to our service provider(s) in order to process and operate your Subscription.

Your use of the Subscription Products and these Terms are governed by our Terms of Service (“TOS”), which is incorporated into these Terms by reference. Please note the TOS contains a binding arbitration and class action waiver provision. That provision applies to your Subscription.

In connection with your use of the Subscription Products and our Services, we or our service providers may collect personal data about you to process and operate the Subscription Products and Services. For more information about how we process personal data, please read our Privacy Notice, which is incorporated into these Terms by reference.

For Subscription Products and Services that are offered in partnership with third-party platforms (such as Zoom), additional terms and requirements may apply. Please review the applicable third party’s terms for more information.

Subscription Options:

The Subscription Products include the following options, as well as other subscription-based products that we may make available from time to time:

  • Heads Up! Gold: Heads Up! for Zoom offers both free and subscription-based play options. The free-to-play version of Heads Up! for Zoom may limit the number of rounds that a user can play per deck, per day. The Heads Up! Gold Subscription allows paid subscribers to play an unlimited number of rounds per deck, per day. This Subscription is offered on a monthly basis.
  • #Ask Away Gold: #Ask Away for Zoom offers both free and subscription-based play options. The free-to-play version of #Ask Away for Zoom may limit the number of question rounds per session. The #Ask Away Gold Subscription allows paid subscribers to play an unlimited number of question rounds per session. This Subscription is offered on a monthly basis.
  • Sway Stories Supporters: Sway Stories offers both free and subscription-based play options. The Sway Stories Supporters Subscription allows paid subscribers access to premium features, such as (for example) exclusive story choices and/or early access to certain content. This Subscription is offered on a weekly basis.

We may also offer other special promotions, memberships, or events, including offerings of third-party products and services, through the Services. We are not responsible for products and services provided by such third parties. We reserve the right to modify, terminate, or otherwise amend our offered subscription plans, promotions, memberships, events, or services at any time in accordance with these Terms.

Trials:

We may offer trials of the Subscription Products for a specified period of time for free or at a reduced rate (“Trial”). As permitted under applicable law, we may determine your eligibility for a Trial, modify a Trial, or cancel a Trial at any time without prior notice and with no liability.

To participate in a Trial, we may require you to provide us with your payment details to start the Trial. By providing your payment details, you agree that we may charge you, on a recurring basis, for the Subscription immediately following the end of the Trial and for every applicable Subscription Period thereafter. IF YOU DO NOT WANT THIS CHARGE AFTER THE END OF YOUR TRIAL, YOU MUST CANCEL THE APPLICABLE SUBSCRIPTION BEFORE THE END OF YOUR TRIAL. IF YOU CANCEL YOUR TRIAL, YOU MAY LOSE ACCESS TO THE BENEFITS OF THE TRIAL IMMEDIATELY UPON CANCELING.

You can cancel a Trial at any time before the expiration of the Trial by following the instructions for the applicable Subscription Product under “Cancellations” below. Please note that unlike cancellation of a full Subscription, you may lose access to the benefits of a Trial immediately upon cancellation of the Trial.

Payments and Renewals:

You may purchase a Subscription by providing us with your payment details and paying the Subscription fee in advance on a monthly basis or on another interval that we disclose to you in advance of your payment (“Subscription Period”). By purchasing a Subscription, you agree that we may charge you on an automatically recurring basis for the same Subscription Period on the day after your previous Subscription Period ends, unless (1) you cancel your Subscription prior to the end of your current Subscription Period through the procedures described under Cancellations (below); or (2) we terminate your Subscription for any reason. As permitted under applicable law and in accordance with these Terms, we may determine your eligibility for a Subscription, modify a Subscription, or cancel a Subscription at any time.

The first Subscription Period of your Subscription begins immediately upon successful processing of your payment details. If you are participating in an applicable Trial, your Subscription begins immediately following the end of the Trial and upon successful processing of your payment details. Your Subscription is valid through the end of each Subscription Period.

Cancellations:

You can cancel a Subscription at any time before the expiration of the applicable Subscription Period. Please find the applicable Subscription Product below for cancellation instructions:

  • Heads Up! Gold and #Ask Away Gold: Open Heads Up! or #Ask Away for Zoom in any Zoom meeting, navigate to Settings, and select "Cancel.”
  • Sway Stories Supporters: Open the game, click on “ “ on the bottom right corner of the screen, and select the cancel option under the subscription settings.

If you choose to cancel your Subscription, you will continue to have access to Subscription benefits through the end of the Subscription Period that has been prepaid. After you cancel your Subscription, we will not charge you any Subscription fees after the expiration of the then-current Subscription Period. Please note that we do not provide full or partial refunds for prepaid payments. In any event, you will be able to continue to use your Subscription throughout the remainder of the Subscription Period for which you have already paid.
